Analyzing an unwitting system that creates a set of incentives inimical to development, the authors offer a new way of thinking about Africa's development dilemmas and the policy options for addressing them. Weak states, aid dependence, crushing debt, and enclave economies, argue the authors, create disincentives for long-term economic growth and even peace. The nature of Africa's interaction with the international system often supports these negative features; thus, the remedy must come from a radical restructuring of that relationship. Africa's Stalled Development heeds that call by presenting specific and innovative prescriptions for change that are sure to stimulate a much-needed debate. Publisher description.

It makes a number of recommendations for future Government action including reforms for higher licensing fees to be charged for higher-risk credit businesses, for a fast track procedure be put in place to suspend credit licenses, and for the new regulator be given the power to ban harmful products. The Financial Services Bill did little to clarify the way in which the consumer credit market is to be regulated. The Committee also wants be certain that the payday loan industry adheres to the highest standards - either through the codes of practice that are currently being developed or, failing that, by the new regulator.
Regulations also need to be introduced to ensure that debt management companies publish the cost of their debt advice and their outcomes, if an agreement cannot be reached during discussions with the industry. Furthermore, effective auditing of debt management companies' client accounts needs to be established. The Money Advice Service needs to provide details of its business plan. Given that the legal aid budget for such services is being cut by 75% the Minister's assertion that there will be no diminution of face-to-face debt advice is confusing. The Money Advice Service will be up and running by April and yet its remit, and in particular its relationship with highly respected brands such as Citizens Advice, remains unclear.

Author by: Kenneth Dyson Language: en Publisher by: OUP Oxford Format Available: PDF, ePub, Mobi Total Read: 94 Total Download: 764 File Size: 46,5 Mb Description: States, Debt, and Power argues for the importance of situating our contextually influenced thinking about European states and debt within a commitment to historically informed and critical analysis.
It teases out certain broad historical patterns. The book also examines the inescapably difficult and contentious judgements about 'bad' and 'good' debt; about what constitutes sustainable debt; and about distributive justice at times of sovereign debt crisis. These judgements offer insight into the nature of power and the contingent nature of sovereign creditworthiness.
Three themes weave through the book: the significance of creditor-debtor state relations in defining asymmetry of power; the context-specific and constructed character of debt, above all in relation to war; and the limitations of formal economic reasoning in the face of radical uncertainty. Part I examines case studies from Ancient Greece to the modern Euro Area and brings together a wealth of historical data that cast fresh light on how sovereign debt problems are debated and addressed. Part II looks at the conditioning and constraining framework of law, culture, and ideology and their relationship to the use of policy instruments. Part III shows how the problems of matching the assumption of liability with the exercise of control are rooted in external trade and financial imbalances and external debt; in financial markets and vulnerability to banking crisis; in the character of the 'private governance of public debt'; in who has power over indicators of sustainability; in domestic institutional and political arrangements; and in sub-national fiscal governance.
Part IV looks at how the problems of mismatch between liability and control take on an acute form within the historical context of European monetary union, above all in Euro Area debt crises. Author by: Bruce Kercher Language: en Publisher by: Federation Press Format Available: PDF, ePub, Mobi Total Read: 33 Total Download: 707 File Size: 50,5 Mb Description: This book examines the law and practice of debt recovery from consumers in Australia. It is the second edition of Australian Debt Recovery Law which was published in 1990. The new edition is updated to meet changes to the law in the past decade, but more than that it now has three authors from three quite different backgrounds.
The academic author of the first edition, Bruce Kercher has been joined by one of Australia's leading financial counsellors, Betty Weule and by the principal solicitor of the Wesley Legal Centre (which concentrates on consumer credit issues), Richard Brading. It is stronger in its focus on the actual practice of debt recovery law, while retaining its statement of the law and its historical analysis and arguments for legal change. An early chapter considers debt recovery outside the courts, including an analysis of the law governing the constant problem of harassment. It then moves through the various stages of obtaining judgments, presenting defences and enforcement of judgments.
The book concludes with a new chapter on bankruptcy law. The principal aim is to present the law concisely, accurately and with as little legal jargon as possible, while also showing how the law is used as a tool of bargaining and threats.
